A Brandon judge overrided a mandatory prison sentence today for a bullying victim who lashed out at one of his abusers.
John Menzies sentenced 21 year old Bryce McMillian of Carberry to one year in prison and two years of supervised probation.
McMillian pleaded guility to reckless use of a firearm in 2011 when he admitted to shooting 6 shots into the home of a person he claimed had been tormenting him.
His lawyer Robert Harrison says it was an unusual case.
The Crown had wanted a minimum sentence of four years, but Menzies has said it seems ridiculous to send an otherwise law-abiding citizen to prison, considering the unique circumstance of his crime.
