A Winnipeg woman is suing Tim Hortons claiming she had a severe allergic reaction after drinking tea that contained cream instead of the almond milk she ordered.
25-year-old, Gabrielle Lien Ho, is seeking damages for pain and suffering, mental distress, past and future costs of care and income losses in the statement of claim filed at the Manitoba Court of King’s Bench on November 1st. She’s suing the restaurant franchise, one of its subsidiaries and the operator of the Tim Hortons at Kildonan Place in Winnipeg.
The allegations have not been tested in court and a statement of defence has not been filed.
The suit says that back in June, Ho ordered a tea using the Tim Hortons mobile app, and replaced the dairy option with almond milk.
Ho, who has a diagnosed milk protein allergy, says she suffered an immediate reaction after taking just one sip – and called her mother, who helped her administer an EpiPen on herself. A co-worker then drove her to Concordia Hospital.
Hospital staff reportedly had to perform C-P-R for eight minutes until her heart restarted.
